Damaged tooth and sclaing procedure

I attended second round of scaling yesterday. I have two broken teeth on either side. This time, the hygienist broke off a sizeable portion of my damaged tooth and today I am in significant pain. Should she have been as aggressive with that tooth as she was with the rest? When I pulled the broken piece of tooth out of my mouth and showed her, she was dismissive ("Sometimes that happens with decayed teeth"). Is she accountable to any degree? Or am I just an unfortunate person that gets to go to the dentist's office and have his tooth broken by a professional and suffer when I was fine before sitting in that chair?
